These Terms of Service ("Terms") govern your access to and use of the Photoman mobile application and related services (collectively, the "Services") provided by Beyondle (OPC) Private Limited ("Company," "Photoman," "we," "us," "our"). By accessing or using the Services, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. By using Photoman, you represent and warrant that you satisfy these requirements.

3. Your Account

• You are responsible for maintaining the security of your account and device access.
• You agree to provide accurate account and business profile information.
• You are responsible for all activity occurring through your account.

4. Service Description and Availability

Photoman provides AI-assisted image enhancement and branded content tools. We may modify, suspend, or discontinue parts of the Services at any time to improve functionality, security, or compliance.

5. Acceptable Use

You agree not to misuse the Services. Without limitation, you must not:

• Use the Services for unlawful, harmful, fraudulent, or abusive purposes.
• Upload content that infringes intellectual property, privacy, or other legal rights.
• Attempt to reverse engineer, interfere with, or compromise the Services or related systems.
• Use automation or scraping that disrupts platform operations.

6. Your Content and Rights

• You retain ownership of content you upload to the Services.
• You grant us a limited, non-exclusive license to process your content solely to operate, secure, and improve the Services.
• You are responsible for ensuring you have all rights and permissions needed for the content you submit.

7. Purchases and Payments

• Paid features, packs, or credits may be offered through third-party payment providers.
• Prices and feature availability may change from time to time.
• Refunds, if any, are handled according to applicable law and provider rules.

8. Intellectual Property

The Services, including software, branding, logos, interfaces, and related materials, are owned by the Company or its licensors and are protected by applicable intellectual property laws.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, available at /privacy-policy.

10. Third-Party Services

The Services may integrate or link with third-party providers (including payment, messaging, AI, and infrastructure services). We are not responsible for third-party services, terms, or availability.

The Services are provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted, error-free, or fully accurate outputs.

12. Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or goodwill arising from your use of the Services.

13. Indemnity

You agree to indemnify and hold harmless the Company and its officers, directors, employees, and affiliates from claims, liabilities, losses, and expenses arising out of your misuse of the Services or violation of these Terms.

14. Suspension and Termination

We may suspend or terminate access to the Services if you violate these Terms, create legal or security risk, or as required by law.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after updated Terms are posted constitutes acceptance of the revised Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, courts in Chennai, Tamil Nadu, India will have exclusive jurisdiction over disputes arising from these Terms or the Services.
